i was a new hire on 3 month probation on an at will basis. I was fired after 1month. My employer never had a trainer for me despite supposed on the job training yet she expected me to learn the computerized system (medical assistant) if i was so bad why did she give me duties like dealing with problem accounts when i didnt even have the basics down??
One time i mispronounced the word epileptic and she corrected me in front of everyone. She told me i had to clock out for lunch but my coworkers told me that they never did. i think she fired me due to my age. The last meeting we had she met with me and told me she felt i wasnt being proactive in my training becase one day she asked if she could enter info on my computer and i got up to let her- she said i should have told her i wanted to do it...I could not read her mind! i thought she wanted to do it She told me one day that the next day she wanted me to figure out how to do things on the computer and if i mess up i could learn from it and she even told me she expected me to be uncomfortable but it went very well! then about 6 days later she fires me with no reason. Does her feeling that i did a poor job mean anything if she didn't have me sign anything that said we discussed my performance?

every thing here is legal, training is not required, just wise...
progressive discipline is not required, just wise...
you were hired "at-will", that means you can quit at any time for any reason or no reason and can be fired for the same...
file for unemployment insurance and if they did not have cause to terminate you then you will qualify for benefits (assuming that you meet the other criteria). the only time you can claim wrongful termination when hired "at-will" is if an illegal act is involved such as discrimination or retaliation for filing a regulatory based complaint. |

You were on your probation - and they can let you "go" at any time without giving you any reason(s) - even after that.
There could be any reasons. She may not have liked you personally. She may have felt that you were learning too slowly. Whatever it was, it's as bad and painful as being dumped without being told the reason. It's better to move on--if you try to fight it, it will eat you up. Better to spend the energy looking for a new job.
Next time you apply for a job, find out more about what exactly you are expected to do--and if you're not familiar with it (for example, the computer system)--ask if you will be trained, and so on.

You don't have any basis for a wrongful termination claim. You were fired legally. And she had no legal requirement to even discuss your performance with you, or to have you sign anything if she did. |

From my work experience, the employer must document any kind of disciplinary action, and explain it to you and to protect themselves have you sign it so if they do fire you later u can't say u didn't know. Sounds very unfair what happened to you call HR and appeal your suspected wrongful termination. B/c you don't want someones personal vendetta holding you back from future endeavors. Good LUck |
