I had a car accident on the job. ER Diagnosis was inacurate but not discovered till later what can I do?

This is the whole story. I live in Ohio I was working in Utah on a pipeline job for a Canadian based company. I was in a rollover accident I was a passenger when the truck I was in rolled down a 150ft cliff I was thrown from the vehicle after about 2 rolls and slammed my back into a tree. The guy I was with rolled all the way down, and did not make it.

Facts.
Canadian Vehicle/Insurance
Canadian Company
US soil

I was transported to a trauma center in Salt Lake City it was 4 hours after the accident that I received treatment. The ER Dr called it a Strained Lower Lumbar.

When I returned home I tried relentlessly to visit a doctor, but was unable to because a workers comp claim had not been filled by my company. it took them 2 months to file the claim. When I went for treatment it was discovered I had a herniated disc and a chipped vertebrae.

The Managed care company that they used is refusing the diagnosis stating the injury could have occurred after the accident. Now Im fighting just to get treated for the real problem.

What are my options if any for getting the treatment I need.

I have quit working for that company because I could not perform the job duties anymore. My current insurance considers the injury a pre existing condition.

I would start with workman's compensation. Because they do not want to pay benefits for a Canadian company they should work to get this straighten out. If they are of no help you may need to hire a workman's comp lawyer.

I am Canadian, so I don't know the US legal situation, but I am sure there are similarities.

If you are hurt on the job in Canada you are entitled to file a workers' compensation case. You may or may not be successful in gaining compensation based on the details of the case.

Whatever you do DOCUMENT everything and seek legal help.
