I have a full time job and just recently applied in the health care industry for a part time evening job. I was up front during the interview because I knew they would run a background check anyway. They want references and I gave them my current job reference. When they call my current job (which I've been there for over a year) can they disclose the info that I'm a felon? I do not want my current job to know this.
I am thinking of calling this part time job and telling them not to go ahead with this application because I'm afraid they will spill this info.

NO. It is illegal under the employee privacy act."Safeguarding of Privacy Act Records" . Only with your consent can they disclose this sensitive information. Even if they could do it legally, why would a potential employer disclose this information with you present employer. You're just a little paranoid, Don't sweat it. |

I believe that you need to be totally honest about your background. You should tell them all about it yourself and not let them learn about it through the back door. You may find that many people will respect you for that and you may find that the door will open for you. |

No, they can only verify employment, and/or ask your previous manager about your work expereince. However, if you lie on the application and they run a background, then you'll know what the outcome will be. |

it is a common misconception that employers can only ask certain questions, they are free to ask what ever they want as long as it is the truth, it is a urban myth that only 4 questions can be asked, as long as it is the truth and pertains to you they can reveal anything they want as long as it is truthful. |

THEY CANNOT DISCLOSE ANY INFO BESIDES THE DATES YOU WORKED THERE....
If they told more you can sue them.

BY LAW THEY CAN ASK UR CURRENT JOB ABOUT THE CHARGES BECAUSE U PUT THEM AS A REFERENCE... THAT GIVES THEM THE RIGHT TO ASK ANYTHING THEY SEE FIT TO ASK...
