I have been handed an official warning letter. Most of the allegations are unsubstantiated and untrue. I am reasonably confident that my performance will be termed unsatisfactory and my employment will be terminated in a month or 2 month's time.I do not want to get into filing a case etc. against my employer because I have been looking for a job anyway. Ideally I would have liked to secure a new job and then resign.
With this in mind, what is the best way to stretch my resignation for as long as possible keeping in mind that I -
a) Do not receive any additional warning letter(s) or a termination notice
b) My reputation is not damaged in any other way possible
Any real experiences would help.

"Any" letter you receive you are allowed to rebut. Write a response back advising that you were not the cause, you were not involved, you didn't do anything because, etc. and that the allegations are unsubstantial and untrue. Keep a copy for yourself. Before you leave figure out who there "would" give you a good reference (and test it out by a call to them after you leave to see that they were authentic). If you know of someone who caused the problem or the situation you may suggest that they look elsewhere (you don't have to say who, what, where, etc. just that it wasn't you).
They have the upperhand always because they are the employer. Some states are "work at will" and don't have to give warnings and all of a sudden you're out. But it seems there is something going on thats the reason they are warning ahead. A warning usually means "start looking for another job". Employers don't forget what they are told and people just don't erase things from their minds. So update your resume and circulate it. If you are unemployed then see if you can get unemployment comp. Lots of people go thru this and it's unavoidable. If you already have a computer business then step up its pace so you will have income in case you are let go before you were ready to leave. Sometimes employers give warnings because if they warn then they can make you leave and they don't have to pay the vacation money that was due you. At any rate, it sounds like a trick to me. If they see you are leaving they more than likely won't give an additional warning, although they may let you leave early with or without pay. It's better working for someone you like and who likes you than working for people who just want to cause you problems and grief. If you leave it's still of your own accord. If you leave when they want you to it may be a blot. You may be being used as a pawn, as in they may need just to cut staff and they don't know how best to do it. anyway....best of luck to you. |

Just keep doing your job while looking for a new one. If the do fire you, just file for unemployment until you get that next job. Just remember if you quit before you find another job you can't get unemployment. |

i think you should first, ignore what had happen,while keeping in mind what you were acused of. try to avoid doing what they said you did. if you get another letter acusing you of even more wrongs, then it COULD be that they want you to leave. so start looking for another job, cause if it continues you COULD find yourself out of a job! |

Just look harder and save money until you do get a new job. Sometimes it just happens. Just do your job, no attitude and try to improve. It may not help this job but might teach you somehting valuable for the next one. |

The best way to approach this would be to hire an attorney to send a letter to your employer. That letter would address each allegation that the employer made and would respond in a logical manner using legal terms.
Why would you want a lawyer to do this? 1. Because the lawyer is not the one being warned and could address the allegations from a neutral, non-emotional perspective. 2. Because it would show your employer that you took the warning very seriously, that you also take an unfounded accusations that would hurt your reputation seriously, and that if the employer continues to accuse you of things you did not do it could cost them a lawsuit. 3. Employers do not care about being fair. What they do notice is anything that even hints at a potential lawsuit, whether or not you intend to file one.
