Find answers to your legal question.

I have been underpaid in my wages for the past 18 months. How much of this can i claim back?

I was underpaid in my normal 4 week wage and was not being paid extra when it was a 5 week month. So i was receiving well under the minimum wage. How much of this can i claim back from my employer?

It's not to late at all. In the first instance you should formally advise your employer with a written communication that you believe you have been paid less that the minimum wage or whatever other reason you have for alleging the underpayment.

Document your case carefully to the employer detailing dates and proof with copies of your payslips or bank records (removing personal data). If your application is unsuccessful.

On your personal issue it may be that the employer has you on a salary and it makes no difference how many weeks there are in the month, each month will be the same irrespective of 28 days or 31; if alternatively you have been paid every 4 weeks (which is unlikely) you would be looking for 13 annual payments as opposed to 12.

Either way you should make your concerns known and detail a calculus showing why, after careful examination they will explain how they arrive at your payment levels.

As long as you have documentation, you can claim everything owing to you.
I'm curious though... why did you accept being underpaid for 18 months???
If I'm underpaid for 1 month, I kick up stink... more than 3 months, I'd be filing a claim straight away!

You can claim ALL of it back. If you are in the U.S. contact the Department of Labor at 1-866-4US-WAGE. They will connect you to your states wage and hour division.
