I have been told today that i have 3 months to find another job because they are stopping my particular hours which i have worked for the last 3 years (they have offered me hours i am unable to do). I have told them that i am taking them to court under constructive dismissal (as i have been advised by my solicitor). If i find another job in the meantime then i assume this will stop me from taking them to court? Additional Details Cannot ask my solicitor this question as she is away at the moment.

Be careful.
A solicitor stands to make a lot of money from you by telling you that you have a case. I find this hard to believe as you have not yet finished your employment with this employer. To inform them that you are taking them to court for constructive dismissal allows them to double check that they do everything properly from here on, and you may find yourself out of pocket.
You have been asked to consider changing your hours can you not meet them half way? or request reasons why they find the need to change your hours. try to give your employer some options as this will show that you are willing to discuss the situation and only if they are adamant that your employment is to end can you consider contacting a solicitor. It is much easier to keep your job while you are still employed than to take them to court for unfair dismissal.
Start collecting relevant documents and keep copies of all correspondence that you receive regarding your employer you will need these for your case if a solicitor decides you have one.
You can look for another role it won't affect any claim made on a previous employer but i would keep it to yourself as any new employer may see you as a troublemaker.

If you are in the UK you don't need a solicitor, contact ACAS www.acas.co uk they will tell you that if they change your job any any way or move to a different area or even if it is 1 mile away but inconvenient for you to get there you can claim redundancy under constructive dismissal, I was in similar situation last year but nothing came of it until we returned to work after new year when we were sent home as he had no money, I registered with job centre, 3 months later I got a fantastic job with fantastic wages and yesterday I won my case at employment tribunal. I only asked ACAS for advice and done the rest myself. |

Sorry to hear that Karen. I think that even if you get another job, you can still pursue this case because of the wrongdoing done towards you. I mean, whether you find a way to take care of yourself after the fact, doesn't dissolve their previous actions.
I guess it also depends on if they get rid of your actual position. I know that a company can get rid of a person if they get rid of the position, then they have the legal right.
If I am not mistaken, I think it's against the law for them to change hours on you unless you signed something that specifically states that they can do it. When you are hired for a job, you agree to a shift, an amount of hours you are willing to work etc.
All of this is speculation though, I know some parts of the law but I am sure it also depends on where you live, the law varies depending on what state/country you live in.

I think you'll find it very difficult getting contructive dismissal as they've offered you other hours.
I think you'd be better off spending the three months looking for a job rather than wasting it with solicitors.
If you do pursue the case, getting another job will not prevent you carrying on with the constructive dismissal case with the old employer. |

I am sorry to hear about you loosing your job, try and ride out what they have offered you but in the meantime look for work, it is much better to have a job and look rather than the other way round.
Sorry to say but you may be wasting your time taking them for constructive dismissal as they have offered you another job, do not waste money on solicitors, keep the money in your pocket and do job search.
You can do this online type in job search and see what comes up.

see it as an opportunity to do something else...and get looking
and sending our cv out....
i would not waste time with legal action..would all the costs+stress+time be worth it...when you can move on and forwards which is more constructive.
also you not alone....i heard similar things happening to alot of others too.
maybe its a blessing in disguise....where one door closes another opens????

it looks like what they are doing is trying to avoid paying you a redundancy settlement by giving you notice. Had you been there 1 year you probably would have been given 1 months notice.
The reason you would take another job is because they are giving you notice and terminating your contract. You wouldn't be looking for a job otherwise so if you do get another job this doesn't make a constructive dismissal case disappear as you are doing exactly what has been instructed.
As the fees are being paid I think you should take this through the system.
You may be offered an out of court settlement in the mean time.
be sure that you do get the 3 months notice you have been given in writing. |

I am not sure of the legalities Karen, but I think you can still take them to court as you are being forced from a job that you enjoy doing at hours that suit you.
The fact that you have done this job with those hours for 3 years has to stand you in good stead, as your employer had been happy with those arrangements.
And if you drop the case, then they will get away with doing the same to others in the future.
Even if you took the hours to suit them, what is to stop them from changing them again at a later date. |

They offered you those hours.If you want your job you have to do that job UNTIL you can find another.At least they told you.Why do you think you can sue them?? If you are not in a union or have a contract,the LAWS OF YOUR STATE DO NOT HAVE THOSE JOB PROTECTION GUILDLINES,YOU ARE WASTING YOUR TIME.Plus after the battle is over your job will become tougher.In alabama the boss can come in and fire you for NO REASON.WITH NO STATE LABOR LAWS THAT ADDRESS HIRING/FIRING OF AN EMPLOYEE,YOU HAVE TO TAKE IT.That is why a lot of companies are coming south.....these states do not protect its workers in that area i just addressed.if you have children you will have to make arrangements,if it is you only work those hours,BECAUSE THE COMPANY WILL SURVIVE WITHOUT YOU.........ALWAYS REMEMBER THAT!!!!! |
