I am collecting unemployment and they never contacted me.. I live in washington and i worked there almost 4 years. Is there legal action i can take?

Since you were laid off( And not terminated), you have a lien over the post, and legally you should be employed in the post and lay off lifted. If the management has hired some one else , it is illegal and amounts to unfair trade practice. Please file a complaint with the labour department immediately.

They have NO obligation to let you know about the opening. There is NO legal action you can take, unless you can prove there is discrimination involved. |

Why? Your employer has the right to let you go at anytime (unless under contract). Perhaps they eliminated your position but found that they needed it. |

No, unfortunately it's not illegal. In our current economic climate It's very common for an employer to rid themselves of problematic , under performing or unliked employees under the guise of "layoffs."
I'm not saying you're any of the above. It's sad to say, but unless you have the financial resources to pursue this in court (basically sue them), they you're SOL.

Regardless of the issue of whether or not you have any legal action, there's no restriction that you cannot reapply for the same position and return to your original job with all the benefits that come with it. My advice is that it's worthwhile to complete an application and go through the interview process with the old employer since the outlook for a similar job at a new place does not look good.

It's sh!tty but legal
I had 4 weeks vacation and made $22 an hour
now they have high school grads doing the same job
and in this economy they can get away with paying
new hires $10 an hour and no vacation time. |
