I just got fired.....?
Find answers to your legal question.

I just got fired.....?

over a policy that the company clearly does not apply across the board. Any suggestions?

you can talk to a lawyer but it may be really expensive to fight them. I got "asked to resign" from my job a few years ago and never got more of an answer than "its just not working out". I worked there for almost 2 years, never got any warnings or written up, just asked to leave. It was really strange but i am better off now with this job so it turned out ok. I did go thru some terrible depression tho, drinking before noon was my fav thing to do! It is really hard on your head to get fired, especially if you dont know what you did wrong or did something wrong that you didnt know was wrong.... good luck to ya!

Can you prove that they don't apply the policy equally?

If so, you can sue for wrongful termination. The company will have to prove that the policy is 1) fair and legal 2) applied to all employees equally 3) posted at the job site or published in the employee handbook 4) that you were made aware of the policy (through orientation or getting an employee handbook).

If you cannot prove that it is not applied fairly, then you are out of luck. And remember, by proof I mean you must be able to show that the policy was ignored in a particular case and have others to back up that claim. Your word vs. their word means you lose; so you will need other people and or written proof.

Good luck!

If you can proved the policy isn't applied to everyone equally take your documentation and contact your local labor board. They will be able to point you in the right directions. But you have to have documented proof or else your gonna make yourself look like an idoit!

Start looking for a job right now. Sometimes a situation looks really glum, but put your heart and soul into finding work, and things will work out the best for you.

1st suggestion would be for you to write what happened so i can give a better answer
2nd if they are in the wrong you may sue
3rd maybe you were wrong.

not much you can do about it unless you can get others in company to stand beside you in saying its an unevenly applied policy

talk to your local labor board and see what they say

Unless there is a union, you might have a problem with justice. You could contact the higher-ups above those who fired you, but you'd have to fill out paperwork that could a couple months to get processed. And you still might not have a job after all of this.

"Employment at will" usually is the case... your employers can fire you at anytime for any reason.

(But I know how you feel, my husband was terminated last week in the same situation)

Welcome to the working world. Unless you have proof that you were singled out....there is nothing you can do about it. Be happy that you don't work for a company that only applies it rules to certain people. I've come across lots of jobs like that. Obviously the reason you were fired was not because of that rule...it's more likely that they just wanted you gone for their own personal reasons. Rules that only apply to some and not all are set because the person in charge is lonely. They feel if they let the people they like slide....then they will like them more. Yes adults are this way. Childish...but true.

Lay back enjoy unemployment and find and a job that you love.

companies are a bunch of P*ssies

First you need to ask yourself if this is a battle you are willing to fight. If so, then contact the human resources department and inform them of this breach of policy. Inform them that you intend to take action against them if they don't find a solution to the problem. You will then probably need to find a lawyer that specializes in these types of cases. It can be costly, and often times doesn't end well for the employee, because it is hard to prove your case.

It might be better to just let it go and start looking for a new job. I know that's hard, and what you really want is to fight this. Is it worth it though?

well, if it doesn't apply across the board then it was a scape goat to get you out of there... fighting the company will only make it worse but I can suggest that you seek the labor board but make sure you have the right evidence to clarify that....

Good luck

you need legal advice to find out if this is grounds to fire you

File for unemployment, start looking for a new job, and move on. If you violated a company policy and that was the reason for your termination, it is unlikely you can do anything about it if they choose to not fire someone else for the same offense.
