I just received a legal document that is a request for entry of default? What does this mean?

I know I'm being sued I got served months ago. Does this document mean I missed my court date? What does it mean?

You were served with the summons and complaint and failed to timely respond (you have a limited time to respond [file an answer, demurrer / motion to dismiss, etc.] which is usually 30 days after service.
If you fail to respond to the complaint with the limited time period, the plaintiff / party suing you files a "request for entry of default" which is the first step in securing a default judgment against you.
Depending on the state, they may have to serve you with a statement of damages before getting a default judgment. So, if it wasn't served with the summons and complaint and other documents, default cannot be entered (at least I think that it is the case in California).

sounds like you are in default for a loan or debt of some kind and they are now registering you for bankruptcy?! Could that be possible? Obviously I don't know your financial position but you do so you will know!! |
