I live in NC and is okay by law for an employer to cut your 4th of July bonus from 3% to 1.5% with out notice.

They also said if we did not like it, we could refuse the bonus and they would sign us up for that week. The employee handbook clearly states 3% for all bonuses. Can they by law do that. I would be loosing alot of money either way. I want to know should I take this to the labor board or is this legal?

It probably also states something like "Upon approval of the board, bonuses..." There's gotta be a conditional aspect to bonuses in your contract. Besides, who the heck gets bonuses for the 4th of July, where do you work, a fireworks factory?!

The definition of bonus is "in addition to" Be thankful you have a job, maybe high gas prices are eliminating their profits. Or be like GM employees, demand you bonuses and raises and then act all surprised and indignant when the plant shuts down.

Yes, they can do whatever they want with a bonus. A bonus is just that - a bonus.

And it's all very legal!

Your handbook is not a contract. It merely outlines your conditions of employment. Your employer may legally change anything it contains. Given the current economy, I think you should happily accept any bonus your employer is willing to give you, because that's what it is...a gift.

Legal. They could not give you anything and have it be legal. Bonuses are at the sole discretion of the employer and they can give as much, as little, or none as they want.

It is my understanding that bonuses are not to be expected unless the company is flourishing and/or certain people merit same. If your bonus was reduced, be lucky you are getting one at all. I am not sure what the rest of your handbook says, but that is how our bonuses work.

Bonues are taxable, but not mandatory for any company. If the company did not make a larger profit than last year, they have that right. Have you seen their profit and loss statement for the last quarter? If not, ask to see the company's statement.

Unless you are working under a contract that specifically addresses your wages they can pay you anything they like as long as it does not violate minimum wage laws.

You are under no obligation to stay with that employer, either.

I would imagine that your employee handbook also states that policies and wages are subject to change by management with little or no notice.

If your company is cutting bonus pay, you may want to look further into the financial health of your company and keep an eye out for other employment opportunities.

It would depend on *exactly* what you're employee handbook said. Bonuses, by design, are not guaranteed so likely they can do this. My guess is they can. You should check with your local legal aid department if you're unsure. However, keep in mind it's never a good idea to sue the boss. ;)

I am not sure if it is legal in NC or not, but I do know that the labor board is a good place to go for help. I would call right away so that action can be taken immediately if needed.

TOTALLY Legal. Companies (for the most part) can do whatever they like for "at will" employees. Meaning if you're not part of a union. Facts are facts. You might be able to win a class action suit but I wouldn't persue it- the lawyers would eat up all the money. Good luck.

Holiday pay is usually double time. They don't have to give you more than that. It sounds like you're getting less. I don't know the NC laws, but try googling it, there are probably dozens of websites with this information.
