I live in indiana and was denied a job application due to being a felon and was wondering if that is legal?

I went to a temp service to put in and application for boston scientific in spencer and was told that they will not hire me because I am a convicted fellon even though it has been 10 years since the convicition.
I know by law every employer must give you and application no matter what and it struck me as very offensive and degrading and would like to know if I can sue them for discrimination.

in many states this practice is illegal but under federal law and Indiana law it is allowed. being a felon is not a protected class and as such can not be "discriminated" against.
is this right or fair? NO but it is legal.

Nope, you committed a crime and people don't want criminals working for them. They didn't discriminate against you because being a felon is something that you choose not something like being black or gay.

It would depend on your line of job/type of job you are applying for and the felony in the past. Sensitive jobs such as working with children, healthcare, handling sensitive information, etc are more strict on hiring policies. You can check with a lawyer and state/federal laws but again some employes might actually have a good excuse.

This question is the most agonizing part of any ex-offenders job search. Some believe by being honest they don’t have a chance at getting a job. The fact is an employer cannot legally refuse to hire you because you have a criminal record unless the conviction is directly related to the job for which you are applying. I have spoken with former inmates who have lied on applications and gotten jobs, only to lose them later when background checks were done. Some have been encouraged to use the response Will discuss at interview. In my opinion, these are not good practices. The best advice I can give is BE HONEST! Employers have a responsibility to know as much as possible about prospective employees. There have been employers who have been found guilty of negligent hiring when employees who have criminal pasts committed acts that resulted in harm to others. Those situations could have been avoided by careful screening through background checks. Employers will ask directly on applications about criminal convictions as a means to protect himself, his business, and others.

But for other people on here who have prejudged a person for PAST problems need to be ashamed of themselves. Keep your head up and remember everyday is a new day at life!!!

lol no they have every right. who would want a felon working for them? If you wanted work you shouldnt of committed a felony in the first place.

Discrimination........you did the felony......and now you want to sue an employer for discrimination.........you didn't learn anything in jail.......you did the crime and the time........your actions will follow you forever...........

Sadly no, In today's society employers do not view the debt you paid to society as sufficent to give a felon a job. I do not agree with this, but it is the way of things at the moment. It kind of perpetuates the cycle and encourges people to go back to crime. Just keep trying and don't settle. I am a 2 time felon that after my convictions went to college, and now make double the salary of the same people that would not let me clean their floors a few years ago. There is cosmic justice man, you just have to work for it.

No it's not illegal. I wouldn't hire you either, no offence. I don't care if it has been 10 years. Discriminating against criminals is okay in my book.

check to see if you live in a right to work state, they also may give you some informatin on what to do, you will problbly have to go back to the employment services, but dont stop at the local level, they are the only ones who have the info. of who to contact, best luck,
