I need help with unemployment appeal?

CAn someone help me with this. The employer I worked for is appealing the decision and I am very nervous?

I would be more than happy to assist you with you unemployment appeal. I have represented many individuals such as yourself across the US in the appeals process.

Most state's Unemployment Offices recognize my credentials to represent a claimant in their state. I would need to know what state you were employed in to determine whether my credentials are accepted in your state.

You should not be nervous, most employers do appeal Unemployment Insurance Benefits that are awarded to previous employees. The employers do not want to depleate the money they have paid into Unemployment, so they appeal as many cases as they can, if they feel they may have even the slimest chance of winning the appeal. However, the majority of the cases that I have handled the employee is awarded UI Benefits. I do not charge for these services only out-of-pocket expenses. I do not need to travel in order to represent you either during the appeal process, so that would not be an expense to you.

In addition, you want to make sure you are prepared for the first appeal hearing so that your employer does not win the appeal in which turn you must appeal the decision and wait even longer to collect benefits that you are most likely qualified to collect if they were awarded to you in the first place.

That is very normal. If you were fired for a good reason or you quit with very good reason you will loose. There's many things that could be here you'll have to explain your situation more.

I know that it is scary, but you should know that whenever a complaint is made or an appeal is made that they will check on it through their files as well. So just be prepared, and keep a cool head, and the people who handle work related issues will know how to mediate.

The DES should have sent you information on how the appeal process works.

If this is a phone appeal its going to be you the referee and the employer (HR). on 3 way. You must listen to the directions of the referee and answer only questions he.she is asking. Stick to the facts.

I'm in the same predicament right now. My ex employer has filed an appeal on me. I'm not going to the hearing because I deserved to be fired and I know it. I'm not going to lie to the judge, knowing that I did wrong. Whatever the outcome, I take responsibility and I'll just have to pay it back.

Whatever you do, just do not lie to the hearing examiner. Worst case scenario, you'll have to pay the money back. If you show no intention of paying the money back, they can take you to court and you could go to jail, but they will want their money back first, instead of spending MORE money on you in litigation. Jail is a LAST resort.

If you can prove that you left for good reason, or if you were wrongly fired, it will go in your favor, but he can appeal again (in MD anyway). If he can prove that he fired you justly, than it will go in his favor and you will pay the money back to them. They will make arrangements with you. You don't have to pay it all back at once.

Its not the end of the world. Be aggressive in your job search and don't let this get you down too much. I had a lot of anxiety about my situation, but I realized it could be worse. This happens everyday. Just remember, don't lie to the judge/hearing examiner and be cool, if you decide to go. If you are in the right, you should.
