i live with my stepmom and i went to visit my mom and my stepmom threw my sons and my clothes away along with other personal items ...can i sue her since i have proof of residency there and she never served me with a court ordered 30 day eviction?

Not a lawyer here, but I think that although you were just living there, you don't have a lease or any signed contract with your stepmom, yes? That makes it more difficult. As well, you would need to have proof of the items you claim were lost (did you keep every receipt?) or other corroborating evidence that you had those items.
What you can do is check the phone book for "free consultation" lawyers local to you. They will hear you out, and if they think you have a case, they will take you on a contingency basis.
If the value of the items you are claiming is equal to or less then the amount stipulated for a small claims court case, you may find it easier and less expensive to try the case in small claims court.
You need to check that information yourself, since it differs from state to state. |

I hope you filed a police report ASAP. If they came in, they would plainly see all your stuff gone and see your proof of residency. This report would be taken as proof to small claims court for the amount of money it would cost you to replace those items. |
