I need legal help, please?

If I were to die, how do I make it so that my parents have custody of my child and not the father?

Or would it be better now to go through the trouble of having my parents adopt my daughter?

Btw, I'm under 18.

I know this sounds selfish.
But the father nor his parents wanted nothing to do with me all while I was pregnant.
Now that my daughter is here, they decide to step in.
They inspect her every time they see her-- every little cough, whine or whimper they look at me and ask me questions as if I purposely made her sick or as if me nor my parents are taking care of her.
Her father never does anything with her-- he'd rather sit and play video games or talk to his friends, and when I ask if he could help me he gives me the "I have to go to school all day and then I work on the weekends. What more do you want from me?"

I think it'd be better to have your parents adopt her.
It might be weird,
but I think they'd have custody of her if anything were to happen to you.

Since you can't leave a will you should sign a statement saying that you would like your parents to have the child in case of your death. This wouldn't present a problem unless the father of the child makes claim, in which case this would probably have to be adjudicated in the Courts.

The father's parental rights would have to be terminated by the court for you to be able to "let" your parents adopt her, and that isn't real likely to happen. He has equal rights to what yours are.

YOu need to create a will. A legal will. Some lawyers will do it at cost. They tell you what to do and then double check it and then they legalize it and your down. They have to by law follow what you request. Seeing how you and the father are not married he does not have to much say but can try and fight your parents so you need to make sure its all right and legal. Also seeing how your thinking of your childs interest if you were to die can I recommend life insurance. My father died two years ago suddenly and did not think of having a plan. My younger brother went from home to home cause after a while no one wanted the resposiblity of him and I lived to far away to get him. Also it cost alot of money and thankfully my aunts and uncles came through for me and paid it if not all my money I had saved was gone. I had to pay for the funeral cost. GL

The child's father has just as many rights as you do.
You don't get to call all the shots.
The child just happens to be with you.

In order to give your parents custody/adopt you would have to go to court many times and prove the father unfit. This is also expensive.
He could come back to court at any time until the child is 18 to prove his fitness.
For this reason adoption would not be considered.

You sound like you have a real hate for this guy that you need to get over or it will screw up your child. I hope you and your parents don't speak poorly of this man in front of thr child.

The facts are that your child needs to know her/his father.
If you keep this from happening, the child will end of hating you and going off in search of her father at about age 14.
