they never had any problems with me.
i just asked to put in my two weeks notice.
i called the next day on the phone to let her know that had class and could not skip class because school comes first,
she proceeds to say "how about we just say this is it. dont come in anymore, and dont ask me for a reference because im not going to give you one." then she hung up.
i dont even know what a reference is in the real world....
but im pretty sure that this is not legal....
does anyone know for sure??
and what actions should i take to reach justice?

YES but.....
in most states you may qualify for unemployment insurance for part of the two weeks that you were not allowed to work
IF the employer did not have "cause" to terminate you.
the fact that you knew your school schedule, your work schedule and did not address the class issue as soon as possible (then called out for the shift) is a real good cause/reason to terminate you.
if your attendance, punctuality or failure to follow policy concerning schedule changes was the reason they used to terminate you then UI is out of the question.
as far as a reference goes a former or current employer may release ANY work related information as long as they are truthful.
i don't know where these people get the idea that it is in some way illegal to give an honest, truthful, complete work reference.
to be slanderous as one person answered requires that the information released is FALSE and the person who released it knew it was false and released it with the intent to cause harm. |

The bad part is, yes it's legal. The good part is: You don't have to deal with such an ignorant person anymore. Seems to me like you're better off not having to put up with that person any longer. And since you were obviously leaving that job anyways, sounds like you just got a little bit of an early vacation.
I don't like the employment laws personally. I feel you pain. Good luck though! |

It's legal, they can fire you any time they please really. It's bad practice and most places don't do it because it gives the company a bad reputation, but they can do it if they please. Not getting a reference is kind of bad, it makes it hard to get another job after this one. Do you have more than one supervisor at this job? If so you should get in contact with the other one and ask if you can use them as a reference in the future. |

It's pretty clear to me that she fired you because you decided to go to class instead of work. (Not saying that's bad, I agree with you, school should always come first.)
An employer can fire you for calling off.
If you're not in a union, or under any contract, then really, you can be fired for whatever reason your employer wants. In fact, they don't even need a reason to fire you, most places have "at will employment."

That's happened to me before.
By law if you put that company down as your last place of employment, the ONLY information they can legally give regarding you is whether or not you really were employed there.
Now if they were to say you were a bad employee, always calling in sick, blah blah blah, you can sue that company for slander. |
