I resigned from my work "effective immediately" for reasons of emotional distress. the company required 2 ?

weeks notice. i did not anymore expect to receive my bonus, but i expected money from my accumulated hours, which up to the time that i resigned was $ 4300+++. is there a chance i could get aound this? i feel that it is my money and i worked hard for it the whole year until i felt emotional stressed from working in their place. help!

i did not comply with the 2 weeks notice due to reasons of emotional stress, thus i i resigned effective immediately. but for 2 - 3 weeks before that, i have been talking to my boss, informing him of my predicament.

The 2 weeks notice is common courtesy. It's not legally binding. You can resign at any time, however it may hurt your chance of getting a favorable reference.

If you are referring to accumulated vacation and/or sick pay and comp time, you may be out of luck - the company is not obligated to pay you anything except your salary for the time actually worked. However, they may have every intention of sending it to you, but since it is outside the normal payday /accounting procedure, it is taking longer to compute and process. If you are able to have a conversation with your boss, or the HR representative, you should call and ask if you can expect to receive any compensation, and when it would be sent to you, and if not, why not.

If the $4300 was pay for work & hours performed but unpaid, then you are definitely entitled to the $4300. Regardless of the reason for leaving the company, and if you gave two weeks notice, they cannot hold your pay. Send them a letter (certified mail) that you expect the pay within 48 hours of the date of the letter & it is not paid to you within that time frame, you will file a complaint with the department of labor. Make sure that you notate on the bottom of the letter that copies are being sent to the American Barr Association & the State Attorney General Office. That letter will get results. NOW, if the 4300 represents money for something other than 'work & hours' performed by you, then that's a different matter and your only recourse is to file a complaint in civil court.

If you are asking about vacation time, no company is legally required to pay you for that.

Whether you gave any notice or not, they are required to pay you for any hours that you worked before you resigned.

For future reference, you should have remained on the job and contacted an employment attorney. You employer could have been liable for an “intentional infliction of emotional distress” charge. This is much harder to try after an employee quits.
