I signed over my CV to a company?

I signed over sole use of my CV to a company bidding for a new contract, no copy though. I was already working for them in the same customer to whom they where bidding for the new contact, however what is my position if they decide to make me a ridiculous monetary offer or do not offer a new contract at all ? Hi, sorry if that did not make sense i will try again. I am freelance IT contractor working in Germany for an Italian company. The company I work for submitted a bid for a contract and asked for exclusive rights to my CV, ie. so none of the other bidders could use my CV, thereby giving them a greater chance of winning as the customer specifically wanted me to be on the team of contractors maintaining their IT system. Unfortunately I did not take a photocopy of the document they asked me to sign. Now the development project is nearing its end and the new maintenance contract should start. However, i am wondering if now that they have got what they want, ie. won the contract and used all my knowledge to help them develop and test the new system, that they might either make me a low financial offer to continue working fot them or not give me a contarct at all. My question is what is my legal position if they do not give me a job ? cheers Giggsy

It's very difficult to answer what the legal position is, since this is a very unusual situation - I certainly have never heard of anything like this before. However, you've signed a contract and therefore what you signed is legally binding.

There are a few things to think about here though:

If you were a normal employee, you could just leave at any time. Yes, you'd have some kind of notice period to work probably, but it's not like you're tied to the company until the day you die. So surely there must be some kind of notice period / termination date in this case?

If you were going to breach the contract by moving on somewhere else, is it likely that the company would take action against you? Bear in mind that legal fees are often so extortionate that it is often never worth a company's money (not to mention time or effort) to sue employees who breach their contracts. There will obviously be some negative outcomes such as refusal to give a reference in the future, you never being able to return to that company, etc. But that's about the extent of it.

I would assume that if they do not offer a new contract at all, that the agreement that you have signed can be automatically terminated. Them offering you "a ridiculous monetary offer" is different, since that's entirely arguable, and what one person considers to be ridiculous is not necessarily the same as what someone else considers to be ridiculous. Clearly, you cannot go into court, should it come to this, with that argument.

Are you able to ask them for a copy of the agreement that you signed? A normal employee would have a right to ask for their contract of employment. You can then "read the small print" or better yet, take it to somewhere such as the CAB where you can get free advice on matters like this (I don't know if you have the CAB over there, but maybe you have some equivalent).

I agree with the gentleman above, though, we need more details. What do you mean you "signed over" the CV? What exactly did you sign? And you wouldn't necessarily need a copy of your CV, you should have all of that either in your head or in a computer file somewhere.
