I still haven't received my last paycheck in the mail ?

I quit my job on the spot on Saturday 8/16/08 and i told him that day that i want my last paycheck mailed to me. Now its Monday 8/25/08 and i still haven't gotten my last paycheck in the mail. I live in California. So what can i do? Should i wait longer or call and complain? or can i report him/sue or whatever ? Thanks for the answers.

DO NOT WAIT LONGER
the check was to be mailed within 72 hours (if you did not give notice).
call and see if the check was mailed or is waiting for you if they have not got it and not mailed it they need to do so immediately or you can file a wage claim at this site:
http://www.dir.ca.gov/dlse/HowToFileWageClaim.htm
they can not hold your check for any reason in California
(there are a few exceptions but they are limited and you would already know if that was the case)
you do not need a lawyer the state enforces the pay-day laws and if any penalties are owed you will receive those also. |

I think I can help you. My boyfriend had the same problem a few months back. His ex-boss refused to give him his last paycheck. I contacted our state Labor Board & followed their instructions to file against his ex-boss for his last paycheck. I'm not familiar with California laws but I do know it's against the law to hold or refuse to pay an employee their last paycheck. It took about 60 days to get it but it worked he received it in the mail from the Labor Board. Google California Labor Bord & look at the services they provide it will give you all the info you will need. Good Luck!! |

I would give it a couple of more days and then simply call and ask where you can pick it up. What you tell someone may not be policy and it could be waiting for you. If not, ask why not before you decide to report and sue. |

You should call or go there and find out what is going on. I don't know if you had a uniform or anything like that, but if you have a company shirt or such, you might need to bring that back and then they give your paycheck. If that doesn't work call an attorney. |
