I think I am being paid under the minimum wage!! What Should I do?
|
I have just started a job in a chain of pizza shops, working 4-midnight. He said I would get £25 per shift and said something about 2 training days and then 2 weeks trial. I assumed that the £25 per shift was for the training days and it would go up.
However, I asked a 23 yr old girl what she got paid and she said £30 a day, for 8 hours work. This isn't minimum wage for an adult! It should be £5.52, not £3.75 which it is currently.
If I got paid £25 a day, it would work out as £3.125 an hour, but it should be £4.60. £3.125 isn't even legal for under 18 year olds.
I have only worked there for 2 days but what should I do to ensure that I am being paid at least the minimum wage? I don't want to work for a dodgy buisness anyway, theres no point. I got paid £6 per hour in my last job from the age of 16 too!
Thanks Additional Details Even if, I was paid £30 a day, this would work out at £3.75 an hour, not the minimum wage.
And if he calculates I worked 7 hours and had a break (10 mins, I am not even sure that is legal!) it still is only £4.28 an hour based on £30 a day and £3.57 an hour based on £25 a day. Either way still below the minimum wage.

It is illegal and you should follow other answerers advice and take action. Be aware though that if you query this with your boss its likely they'll find some reason why they no longer need your services. If thats the case report them, see below:
HM Revenue and Customs (HMRC) National Minimum Wage Helpline gives confidential help and advice on the minimum wage. You can also call the helpline if you want to make a complaint about an employer who you suspect in not paying the minimum wage. Call the helpline on 0845 6000 678 - lines are open Monday to Friday 9.00 am to 5.00 pm. All calls are charged at local rates. You can also contact the helpline via email.
In addition to this they are breaking the Working Time Regulations - every employee over 18 is entitled to a 20min break after working 6 hours. So I'd see about this too - ACAS can advise - Monday - Friday 08:00 - 18:00 - 08457 47 47 47.
I would take both of these actions, even if I was no longer working there, as hopefully it will bring improvement for the company's other employees. |

Definitely go and talk to your boss about your concern! Bring in evidence, such as from the connexions website to back up your complaint.
Otherwise, this is a criminal offence on their part! |

Get a new job where you are being paid minimum wage. It's illegal for that kind of pay jobs. It's now $7.00/hr for the US for starting minimum wage. What you need to do, MUST DO, is report it. It's unlawful and violates the Equal Pay Act. "All employers who are covered by the Federal Wage and Hour Law (the
Fair Labor Standards Act). Virtually all employers are subject to the
provisions of this Act."
First off, in this pizza shop, are there US Equal Employment posters placed some where visable to employees?? This would state the minimum wage laws. If it is not present that is against the law by this company. Ask someone there, not the boss, where they are located. If they are not anywhere, then there you go. You need to go to this website to be able to contact your local federal equal employment office to report this: http://www.eeoc.gov/
U.S. Equal Employment Opportunity Commission (EEOC)
http://www.auditor.state.oh.us/ConferenceInformation/LGOC/2008PostConference/Unlawful%20Discrimination%20and%20EEO.pdf
Age cannot be discriminated against either! I hope I helped! Oh I forgot to mention too,
I'm not sure which state you are in, but in VA it's $7.00/hr. If you are waitressing off of tips, then it's $3.00/hour plus tips earned from customers because your tips make minimum wage which is legal. So if it is tip based then that can be legal. |

my partner is an estate agent and they pay him £1000 per month to work 57 hours a week! he only gets sundays off and never gets holiday, in my book its best to work for yourself as people take the mickey all the time! this link will help you work out whats going on,if your still not happy you have every right to question pay.also i might be incorrect in saying this but if your working till midnight you might be entitled to special allowances as your working unsocialable hours. http://www.direct.gov.uk/en/Employment/Employees/Pay/index.htm

You need to report your employer to HMRC - go to their website - I think there is a NMW helpline. |

There is an HMRC office that deals with minimum wage violations - you have to look it up on the internet. Report them and then get a better job if you can, and good luck - stick to your principles |

Hi, wondering if you can advise me on what to do. Im 27 years old and recently went for a job interview for part time waitress. The man offered me the job and advised the salary is £4.50 per hour!!! I told him that was below min wage and he tried to tell me it wasnt. He advised me that's what he pays his staff. Also one of the bar men didn't speak a word of English, I find that strange to be working in a restaurant. How do I go about reporting this restaurant?
Many thanks Donna McCallum |
