Okay so I work, or i guess worked, for Pacific Sun-ware in California. I went into work this weekend to check if I had any hours this week and I saw that my name was no longer on the schedule. No one told me I was laid off, or no longer an employee there and I was wondering if they could legally do this to me.
I have not been given hours in a while because the District Manager has been cutting everyone's hours and frustrated enough people that four people have quit before me.
My boss said she understood if I was searching for another job because they were not treating me well, and she understood if I quit to find another job, but she never said anything about being laid off or asking me to leave my job, then I come back later and see I am not on the schedule.
I was wondering if this was legal and what I can do about this?

I'm guessing that you're an "at will employee" meaning they don't need to have a reason to fire you. Just because they did it like cowards doesn't give you any legal recourse. Sorry. |

sounds like they are trying to get out of paying unemployment, go talk to the unemployment folks and see what your options are

Yes it's legal, and no there isn't anything you can do about it. You might be eligible for unemployment though, so file for it and find out. |

I don't think that you are fire, they simple don't have work for you at this time. However, they should not make you come to check the schedule as gas is very expensive for you to come and see that you are not supposed to report to work.
Contact the unemployment office right away. you qualify for benefits, even if they have not laid you off. When an employer cuts the hours of the employees, that makes them entitle to unemployment. You can either do it by internet, call them or go the office.
Going back to the employer. I would try to call them and find out what is going on. But don't ask: Was I laid off? ask: When will you have work for me? Make it positive.
