I hired a lawyer to work my case and after 6 months of working my case he stopped calling me and whenever I called him I was told that he was unavailable. 5 months later he called me and told me that I owe him $1400 in order to continue the case. I didn't pay that because I know that the client isn't responsible for paying anything unless the case is won.
I explained my theory to him and he said that he won't pick the case back up until I pay.
I feel like, normally when you owe someone money they call and send invoices in the mail, because they don't want to be out of any money. I have not received anything of the sort.
I feel that this lawyer has been paid on this case already, it's an injury case due to a MAJOR Major major Company. This case is easy, I think I could've represented myself. The entire incident was caught on camera!!!
How can I find out if he's been paid for my case???

Go to your local courthouse and ask for the number to the Attorney's board. They regulate complaints about attorneys and could really be helpful. I would turn this guy in. |

IF he was paid you would have signed a release for the settlement. the company you are suing will not issue a check without proof you were paid (you could just sue them again if they did that and they would end up paying twice).

how did you come to that conclusion?
did you read your agreement for payment?
no attorney works for FREE they will work for their FEE to be paid on contingency but that does not include "out of pocket expenses". these expenses are rolled into their settlement fee if they win but if you lose they still charge for these expenses.
these can include:
filing fees, service fees, copy expenses, mail expenses, travel expenses, phone expenses and on and on.
you need to read your agreement and then contact the local bar association for assistance. |
