The laws seem to keep changing, when I operated my business which I had for years if a former employee sought another job the only information I could provide if ask was to confirm they had been employed by me and if ask would I hire them back. Contact an attorney. You'll have to involve the companies you interviewed with and that could be difficult because if they go beyond those two questions they two are breaking the law. |

For starters, you have to know what your previous employer said about you to whoever inquired. And it has to be a false statement of fact, not just an opinion.
I think that ordinarily, that is a privileged communication, but if what he's saying rises to the level of libel, that's a different story. But even if you think you can sue him, if I were that boss, the first thing I would do would be to tell the companies who called me about you that you've just sued me. Then it doesn't matter who's right. They're not going to want to touch you with a ten-foot pole. To them, you're trouble. There was something called "libel per se" in NY, but I'm not sure now, where if the false statement of fact was about something that would tend to hurt you in your trade or business, you could recover without showing out of pocket loss. But I don't know what the law is now and I don't think you should sue anyway.
You need to talk to a lawyer if you're going to pursue this. Most companies avoid litigation by withholding comment except for verifying your dates of employment there. But their is nothing requiring them to limit their comments to that information.
The market is bad now. A lot of qualified people who would otherwise be hired without trouble are not getting jobs very easily.
And ex-employers have their own problems to bother about screwing you over; once you're gone, you pass out of their consciousness. I think you should cool off and consult a lawyer to see whether it's worth it. I don't think it is. |
