I actually received a 5.5% pay cut. I've been hashing this out with HR for a year and half and all they keep telling me is that the VP would never have approved the 7% raise. Was this not an implied contract? Do I have any legal action I can take? I'm in management and a salaried employee, do the rules not apply to us?

Unless you have something in writing stating you would be getting a raise, you have no real way of proving you took the promotion on this basis.
If you have been taking your reduced salary for 1 1/2 years, without getting something from the person you spoke to stating that you would not get a pay reduction, then you have no case.
HR only can go on what they have documented. Have they shown you any paperwork that states you would take the pay cut? What documents do you have, and compare them to what they have.
If you have anything that shows that you would get a raise, or even stay at the same rate of pay, then you need to contact an attorney to fight for your wages.

You can absolutely take legal action. In fact, they cannot legally cut your salary in the manner you just described. Contact your State Department of Labor and then contact an employment lawyer (do not retain an attorney who charges a fee for the initial consultation and/or thereafter charges per the hour for his/her services.) Retain an attorney where it is a flat fee for services or they receive payment at the end of the case. |

Your situation is governed by both Federal and your state's laws. From the info you have provided it does look like you have sufficient cause of action to file a complaint at least with the Department of Labor. However, don't try to play Perry Mason, find a local attorney who practices employment law to help you. |
