I want to take vacation but start at another company during that vacation...essentially getting paid twice?

Instead of quitting at one company and then going to the next...I want to take all my vacation (3 weeks) at my current company...instead of really being on vacation I will start at another company. At the end of the "vacation", I will inform my current employer that I quit. There are advantages to doing this including...dual pay is the obvious, but the new company needs me to start at a certain date but there is bonus $$ at my company if I am "employeed" for those 3 weeks.

I am not looking for the ethics of this...rather the legality. If my current company somehow finds out, is there any legal recourse for this?

None whatsoever. In my business it happens all the time. Also it helps because you don't have a delay waiting for your first paycheck. Anyway, vacation is paid time that you have earned and they owe it to you regardless of what you are doing with it. Good luck on the new job.

nope my brother has done this to 2 different companies! worked wonderful for him he actually took two weeks vacation then worked for 2 weeks while being paid for four by the other company.... and the new company hadn't got their license for exactly what he was supposed to be doing so he was on vacation for a month being paid for 2 weeks double pay lol! i wish i had his luck!

u can do this just have it planned to the t i have done this b 4 make sure to give them a 2 weeks notice r a week notice which ever fits into the scheme of things and they will never give u a good reference so never use them have fun and enjoy your new job

legal, but don't ever look to get a recommendation or reference from the old company.

If you were to quit up front, you should still be paid for the vacation time owed to you, and you can start the new job with a clear concious.

it's perfectly legal - you are being paid for vacation pay that you earned at old job - doesn't matter if you are actually vacationing or not - call it a "working vacation" 8-)

Go get your employee hand book and read it. Some companies do not allow the employees to be employed at any other similar place of employment and some don't care. Remember, you signed those paper work. You should give 2 weeks notice because you never know when in the future you might need a job really badly and that it is the only place that would hire you. They will pay you for the unused 3 weeks vacation (to make sure about this you need to read your employee hand book). You also keep your bonus money during the 2 weeks notice because legally you are still working there. Leave the way you come in, with good intentions.

You still get your vacation pay if you quit. Why not just quit?

It is unethical (obviously) but it may be against company policy, and if it is, they have reason to legally with-hold that vacation pay from your final pay check.

My suggestion is to just quit. You still get the money, and your employer can replace you instead of thinking you're coming back and then being stuck in a hard place when you all of a sudden disappear.
