Recruiting Manager was calling me and hinting I was going to get hired they just needed the background check. I told them up front I had a DUI and they said it shouldn't be an issue.
My buddy who got me the interview works for this company. He has a DUI and got hired this past April. We have identical resume's, same past experience and same degree from the same College.
I don't know anything about the legality of hiring anyone, but with everyone telling me its ok to have a DUI, then all of a sudden they won't hire me, is there some kind of discrimination?
Is there anything I can do?

Yeah, the Woman that would be my boss sent a email to the other inside sales representatives a week and a half ago stating they were going to send me an offer letter once the background check went through. Then the recruiting manager just called me and said they couldn't go through with it? I'm confused. My friend has a DUI, I think others that work there do as well.
If I call him, what should I ask him.

Depending on what State you are in there are regs about background checks - did it include a credit check?. You may be able to request a copy of the document.
Probably won't impact your ability to get that job, but you need to know what is there so it doesn't cause problems with a future employer. |

I'm confused. Do you mean they suddenly changed their mind and *didn't* hire you after you thought they were going to?
Since your buddy has a DUI and he got hired by them, they obviously don't have a practice of not hiring people with DUI's, so that wouldn't seem to be the reason you didn't get hired.
(Even if that is the reason, btw, that wouldn't be discrimination. People with DUI's are not a protected class under any anti-discrimination law.)
Could you call the recruiting manager and ask him what happened? Or can your buddy who works there find out anything?

Maybe the company has changed their policies since your friend got hired. Or who knows, maybe they just liked him better - that wouldn't be anything illegal.
They don't have to hire you, and no, it isn't legal discrimination if they don't. |
