I was fired for something that never happened.
One day my husband recieves a phone call, from our boss. Our boss says that I can not go back to work until everything cools down. I was like "HUH?" He told my husband this cuz my husband is the supervisor.
Anywayz~ he told my husband that the night before security made a report on me. I was STILL like "HUH?"
he said that the report was stating that I was argueing with my husband! I was lost and confused cuz that never happened! We were doing pretty good that night, no arguements nor dis agreements. So I was like okay this is a mistake, so at the time I was calm and then waited....waited..then a week passes by. So I call up my boss and ask what is going on when am I going to be put back on schedule. He told me "NO" he can not help me. He said if it was a mistake of identity security needs to let the general manager know that is a mistake. Am like "okay" so I asked my husband to talk to the head security and find out what is going on.
So he did the head securtiy told him that it was a mistake. The head security asked him that the night it "happened" did security ever came and told us to leave or anything like that? My husband said "no" he said this cuz no security on duty ever came and asked us anything or told us anything! So the head security told my husband just to let our boss know it was an mistake. The head security said that he would talk to our boss, if our boss asked him about it. We told our boss, he said "no you can not come back" of course I asked "why?" his reply was.."security haves to let the general manager know that". "Then they have to give me the okay". So I was like okay, if that is so why he has other ppl working there that are not suppose to be there! These ppl were litterally fired and told by security not to come back! My boss hired them back only cuz he knows these ppl for a while out side the business. Anywayz my boss only has a cleaning contract with the hotel. I don't know what to do! He already had 2 new extra ppl on the schedule a week before this happened! As soon as it happened he already replaced me with these 2 ppl. He still won't hire me back! There is no proof of what security "thought" happened! They never pulled me nor my husband to the side and give us a warning, write up, or just plain flat out just thrown us out! Reason...cuz it never happened!!!! I am starting to think this is harrassment!
Reason cuz..I have been fired before from this same boss..but he fired me just cuz i wuz doing my job! It was stupid to fire a crewleader (me at the time)
only for just telling a worker (mexican) what to do ! Am hispanic but born here in the U.S I have noticed he pays all the wet backs more money than me( at the time) and they are new ppl. They can work 2 hours or 3 and clock out as if they were working 5 hours and still get paid for it! He knows this my husband told him time and time again! One of the workers once told me that our boss said that all of them can do that he will pay them. When my husband try to pull it off a few times an he got chewed up for it! So then this leads me to believe that he is favoring mexicans and columbians, cuz he is columbian and his wife is mexican. So I have caught on to this guy! Everyone that is fired get replaced with a immagrant. It's obvious!!! I just don't know what to do at the moment..I really think it's unfair. I need advice on how to tell him to give me my job back or am going to report him ! But it's his cleaning company, but the contract he has is with the hotel! The hotel security guards are the ones who accused these false accusations..what should I do????

Check out how you stand legally but it sounds like unfair dismissal from what you said. |

In my country, this counts as unfair dismissal: you were dismissed without an impartial hearing. You might be able to get free legal help from an access to justice organisation. But in employment matters, you are unlikely to get your job back because of the personal nature of the relationship. The best you can get is probably damages for unfair dismissal.
I suggest you find a legal representative, and start looking for a new job. |
