I was fired from my job because I wrote a bad check here in the state of maryland for $350 11 years ago!?

the courts gave me a sentence of guilt and gave me probation in 2003. I worked for the job for 2 years before this came up. Is it legal for them to do that?

I paid back the check the day of the case in 2003.

They can if reporting a conviction or arrest was part of their application process and you didn't disclose your history. They could also have included teeny tiny legalese on the application that you, like a lot of us, missed while applying (including clauses such as "your employment is subject to termination at any time, at our discretion").

If you wrote the check 11 years ago, why is it that it just went to court four years ago? Again depending on the state laws, where I am from, if you are convicted of a felony during employment, yes you can be fired if found guilty. However, if it is considered a misdemeanor in Maryland, they should not be able to fire you. Your best bet is to contact an attorney and get legal advice. Also, was the company that you worked for Union? If so, contact the Union Stewart and file a grievance. In many cases a Union will get you your job back.

In Maryland, an employer may fire an employee for ANY reason or for NO reason, the exceptions being race, creed, national origin, etc. (the constitutional guarantees). So, the bad check thing, while unfortunate, can't be challenged legally UNLESS it is a cover-up for some other reason falling under the constitutional guarantees.

And most other state are like Maryland. It is called "Employee at Will."

did you tell them that you had a bad check out if not yes it is fair but if you did then no it isn't check into you states equal employment opportunity laws

Gee, do you suppose it's possible they investigated your history because they suspected you were stealing from them?

Most jobs are "at will". They can't fire you for your race or religion and they can't fire you for a handicap unless it's relevant, but they *can* fire you for joining the Boy Scouts, or for swimming on Thursdays, or for driving a pink car. Almost any reason will do, or no reason at all.

And they *certainly* can fire you because they think you're stealing from them.

Yes, it sure is. Especially if they asked if you had been convicted of ANY crimes on your job application and you lied about it.

Also, tell the truth here too....

.....you didn't get put on probation for writing a bad check sweetie...you got put on probably for writing a fraudulent or forged check or you wrote it on an account that was knowingly closed, and then refused to pay when they intially contacted you.

Courts haven't made writing a bounced check (by an honest error) punishable by a criminal court in about 20 years.
