I was laid off, and now may not be able to get unemployment.....?

...because my former employer is telling the EDD that "no official decisions have been made" regarding the layoff and that I may be hired back at some point. Is this legal? Am I still entitled to unemployment even if I "might" be hired back?

I think you should be able to still qualify for benefits, because they usually ask you when your return date is.....see if you can find some answers here:

Unemployment covers even temporary layoffs, you will be able to collect for the time you are out of work, provided that in each calendar week you work less than you are laid off.

All your employer saying is that it is not a permanent layoff and you are subject to recall. So, if they call you up to come back to work, you need to go. If you don't go, THEN your unemployment could be jeopardized. One of the qualifications of unemployment is that you are ready, willing and able to work.

Just do what the unemployment office tells you to do, you should be fine.

I had to lay off my employees for two weeks in December/January. All were called back to work, all drew their unemployment for the two weeks they were off.

But for goodness sake, work at finding a new job!

As long as you have your P 60, and you havent walked out of the job you can claim some benefits regardless off if your ex employee might take you back!

File for unemployment...they get that story from a lot of employers who don't want to pay up.

I think you should find a new job. One with benefits and no layoffs. Cause that is not so nice.
