As poster "Skalywag" wrote the only way you could collect is if your former employer does not contest it. You were fired for "cause" and I have never seen a case where an employer contested on the grounds of excessive absences or lateness and they lost. The claimant (you) lost.

Unemployment? Not if you were fired for cause, and poor attendance is being fired for cause.

usually if you are fired for cause than you can not collect unemployment benefits, it is for people that loose there job through no fault of there own

Collect what ? Unpaid vacation or PTO ? Maybe if you file with the state labor board .

Collect anything else ? Unlikely and the cost of the attorney will be a Lot more than any settlement .
