I was sacked for theft, and they have contacted my new employer who was not aware of this matter, and I have been forced to resign, can my ex employer do this, do they need to wait for asking of a refernece before they make contact.

YES they can.
This is what happens when you steal. It is part of the punishment, and it will follow you around for a long time.
Be thank full that the former employer didn't proceed with criminal charges, or you might be reading this in jail.
