I went to a store and had a pair of Kevlar chainsaw protective pants ordered to the store. I paid prior to delivery. When they arrived, the pants were not the item he told me he ordered. He is now refusing to take them back and give me a refund. Is this illegal? if so, what law is he breaking and what could possibly I charge him with?

Upon ordering a pair of chainsaw protective pants, I specifically asked if the protective material was Kevlar (material highly resistant to heavy mechanical abbrasion, the same used in bulletproof vests). He said yes. i was specific because the alternative to Kevlar, is nylon fibers that catch the sprocket in the chansaw and stops the chain. it can get extremely tanlged in the sprocket, putting a saw out of work for a few days, and the pants can never be used again. So imagine my suprise when my pair ofkevlar pants turned out to be nylon fiber pants, put at kevlar prices.

If you paid with a credit card, call their customer service and dispute the bill. Send them a copy of the original order and a scan of the label from the merchandise. Tell them you won't pay the bill and want to return the item and you want them to reverse the charge. See if they will help you. |

he is not breaking any criminal law. This is a civil issue and you would need to take him to small claims court if you wanted your money back. |
