I was terminated from my job, can I still collect unemployment?

I had a job through a temp agency, and was on vacation and needed to extend my vacation by a day to get home. So, I properly called my temp agency the day before and let them know I was going to be out an extra day. I got back home and found out that I had been terminated, because of a rule I did not know, they said if I ask for 4 days off then I should be back on the 5th day. I have NEVER heard of that! My boss at my temp job said that the temp agency just needs to call him and I can probably come back to work. But, the manager at the temp agency will not return my calls! What do I do? Can I get unemployment, do I see a lawyer for wrongful termination?

Im in Georgia, and yeah I get that it is an ''at-will'' state. What really is getting me is that the manager at the temp agency wont return my calls. I don't understand why she wouldn't, because like someone else said they will loose money by loosing me. I guess what I really want to know is what to do about the temp agency not calling me back? It is beyond frustrating not being able to do anything about this situation just because the temp manager isn't returning my calls!

Because labor laws differ depending on where you work, it's hard to give you facts on what is legal without knowing the country/province/state you were working in. You can go to the website or office of the government agency that oversees labor laws where you work and they can give you a very specific answer.

Regarding the rule that you didn't know - you probably acknowledged it when you signed up with the agency as part of your on-boarding process. You probably sighed off on acknowledging company policies/procedures - and it's likely included in there. Most people don't read them fully.

If you are in a work-at-will job (which most are), then you can be fired or quit, with or without notice, for any reason or no reason at all (as long as it's not discriminatory). Your agency is your supervisor and makes management decisions based on what they hear from the client. If your work site boss (their client) says he would take you back, but the agency won't return calls, then you should let the agency know that you are looking for closure, have spoken to your work site supervisor who was willing to have you back, and are confused as to why they would not continue to try to work through this.

The reason this makes sense is that if you are working, the agency is making money. So it's only logical that they would want you working if the client wants you there.

Lastly - in general, unemployment is based on whether or not you left a potion "through no fault of your own". Meaning that if you were fired (let go because you couldn't adhere to a company policy) then you would typically be eligible for unemployment. In order to maintain it, you would also need to be available for and actively seeking work, and not have turned down work that is offered to you. And that means through your current agency as well.

Do you have an employee policy and procedure manual? What did you get when you were inserviced on procedures for calling out or applying for vacation?

Wrongful termination from a temp job? The whole point of a temp job is that you work temporarily, as the employer needs you. Good luck with that.
