I stopped working my full time job and the next day i was told i could not work for this company after i was hired due to a background check i did inform my last felony was in 1998 however it was 1999 im now unemployed do i have some type of case against this company for hiring me then turn around and change thier mind after i stoped working my other job

Unfortunately this is a hard case to prove. If your state is an employment-at-will state anyone of you can terminate employment for any reason. I am not sure what state you are in but most states when conducting a background check cannot go back for more than 7 years. In my state it is 10. They need to take into consideration what the charge was. So for instance if you were charge for embezzlement and you applied at a bank then no they can take that into consideration and not offer you the position. If you were charge for DUI and you are not driving then they cannot use that charge to deny you employment. It all depends on the situation at hand.
You cannot collect unemployment because
1. you were never their employee (you have to be employed 31 days in order to be eligible for this).
2. you resign from your previous job

No, you have no case. Unfortunately, employment is "at will" for both you and the employer. It's their fault they did not complete the background check before you were hired. Atleast now since you were fired, you can collect unemployment. If you don't want to do that, then go ask for your old job back. |
