Find answers to your legal question.

I work for a company in Calif. Is there any flexibility of work hours if working less than 40 hr/week?

At my workplace, there are 2 others from my company working 40 hrs/week on an alternative schedule, commonly called a 5/4/9, working every other Friday. I wish to work 36 hrs/week, the minimum my company regards as full time. Do I have to work 40 hrs/week , even if my company would not mind me working 36? I want to work four 9 hour days a week without overtime.

Why ask here - only your company can tell you it's rules...and any options available, non?

It is up to your employer to determine the work schedule which is appropriate for each position, and to approve any changes to that schedule. As long as they abide by the requirements of the wage and hour laws for your industry, they can pretty much set schedules with as much or a little flexibility as they wish.

Approach your manager or HR representative with your request and see if you can get it approved. Good luck!

In California overtime is paid based upon 8 Hour Days, NOT 40 hour weeks.

You will not be able to work 9 hrs a day w/o overtime in California.

you have to talk to HR. every company is different and has their own policies. you won't get the answer here.
