I worked in the state of GA and wasnt paid for it What should I do?

I have 3 other individuals that were all told the same thing..the lost wages between alll of us may only be 20-40hrs. Does anyone know the law on this ? I would prefer to sue than to go to the labor board due to the LONG process..would a civil suit be advisable with these hours (is it enought) and do I need more people to participate ? If I sue what else could I sue for as far as "stress" from not getting paid and things like that ..Thans everyone !

No money for "stress", you can file a claim in small claims court, no you don't need other people along with you to file. It may take you a while for your case to be heard, but you can do it.

Better bet is to file a claim for unpaid wages with the wage and labor commission. They will go after the employer and find out details of what is going on. No charge to file a claim.

However, a civil suit could take longer than contacting the US Dept. of Labor.

Write them a letter, certified mail. Demand your unpaid wages in full within 5 business days of receipt of your letter. Include that if they do not pay, you will:
1) Report them to the state labor department and/or
2) File a lawsuit against them in small claims court.

Then, sit back and wait for your check. If it doesn't arrive, do #1 and 2 above.

If you don't want to go to the Labor Board then you should file a smalls claims suit at your County courthouse. You are out of luck on any money for 'stress' in a smalls claims suit.
