The Dr. I currently work for is closing his practice sometime(he has not given us specifics) after the first of the year. He has mentioned a severence package but I worry it may only be for a month or two. Not knowing how long it may take to find a job, I'm trying to determine what my best route to go would be.

Yes you will. If you're severance package is given to you in a lumps sum and the check is dated 01/01/08 for example, you may file the unemployment claim the next day. If it is given to you in installments, unemployment may delay sending you your full benefit knowing that you are receiving a severance paid out like a salary. |

Stephen's answer is right. Try to get the Dr. to pay your severance in a lump sum, on your last day of work. If it's paid out over time, your UI will probably be delayed, which of course you don't want. |

It will state the terms in your severence package and your state has its own regulations concerning unemployment for such a situation. |

Yes, but you will need to let UI know what severance you received from them. Benefits will not start for a certain period of time (in reflection of your severance) but you will start receiving them if you have worked for the required number of months prior to your claim. |

Most severance packages require that you sign a severance agreement which does not let you sue for discrimination BUT you can and should apply for unemployment benefits as soon as you are no longer considered an employee. It does not matter that you got a severance.
Some employers will pay that package through their payroll system which makes you look like an employee until the severance payments run out. You will need to ask if your severance package is a lump sum, or something that pays every month. The majority of severance packages are a lump sum.
Your state unemployment benefits office should have a website where you can get answers as to how to apply. |
