My employer is trying to hold my last check and being a royal *****. I don't want to confront her, so would it be illegal for me to enter the business after hours to get my check? I would be entering with the key issued to me by my employer..After i get my check i will leave the keys on her desk. What do you think?

After having quit the job, you Must have surrendered the key .
Now if you attempt to enter the building with the key , after office hours it amounts to trespass and they may also try to book you for criminal intimidation. |

First, if you enter private property without authorization, even if you have a key you are setting yourself up for a potential legal battle. Trespassing, concerns over company documents, stealing are all things that your former employer would probably consider if you did this.
Second, if you are in the US, and were working in a "work-at-will" job, then it is likely that your company holding your final check - is at some level - illegal. There are very few reasons to hold a last check unless you owe the company money, or they are awaiting the return of company property. Even if this is the case, it is generally not legal to hold money earned.
The better idea would be to report the situation to the division that oversees wage and hour law where you were working. If that doesn't get their immediate attention, the lawsuit and fines that follows will. |

YES. And technically, this key is their property. Schedule a meeting with them to return your key and get your paycheck. It is not legal for them to hold your money either. |

I think they might be able to hold you for trespassing. Even though you have keys, you are no longer employed. Using the keys would be the same as using stolen keys. Be an adult and mail in the keys. Include a letter stating you will report the company to the proper authorities (IRS, SS ) if they do not send the check. |
