If I resigned from a company 3 years ago?

I was the HR mgr., I am now named in a law suit by someone who was terminated after I left, am I obligated in someway to testify for the company?

I know I will need to contact the attorney that sent me the letter.

I have no idea who this guy is, I really can't see how I would be beneficial to either party.

I did not leave the company on good terms. I was not terminated, I resigned because of a conflict with my imediate supervisor.

Not only are you not obligated to testify for or against either party, any testimony to that end would be contradictory to the expectations of our legal system. Your only responsibility is responding, as best as you can recall, to any questions presented; however, the extent to which you elaborate will be entirely up to you. Shorter answers would best facilitate the separation you, apparently, wish to maintain.

The company already has an HR manager to represent their interest. If the terminated employee was hired during your tenure, your testimony would help establish the atmosphere at that time which, with little probability of change, continued until the termination.

There is no need for planning or preparation. Honest and straightforward answers will be sufficient. Good Luck.

If you weren't involved in this person's firing, I'd think that a formal deposition would be sufficient. I agree -- you should talk to the attorney to see what he's really asking of you.

Contact the lawyer, see how you are involved. They can subpoena you if they feel you are important in their case
