I have been working night shift since november 20th and want to know if i am owed back pay for something I have been doing for 6 months and counting.

It's not uncommon for companies to pay a shift differential, but is not required by law. As long as you are being paid at least the minimum wage, they can pay what they want to, can even decrease your rate after you are working for them - your option is to find a better job if you aren't satisfied. |

No. Some companies do offer shift differentials for working nights, but the law doesn't mandate that. |

Contact the government agency that oversees employment law in your area. You can go to www.usa.gov and search "Texas wage law" and it should send you in the right direction.
That said, generally speaking companies can CHOOSE to pay a differential for second or third shift, but if you are in a "work at will" job, it is completely discretionary for the company. Just as it is completely discretionary for you to leave the job with (or without) notice.
This all changes if you are part of a union, or signed any kind of employment agreement that governs hourly pay. |
