I have been asked this question when telephoning for details about jobs so its not for pension purposes or any other than to discriminate.

Whats the difference between asking your age and asking your date of birth?

When asked my age I ask if their company is operating an age discrimination policy. They say they do not. I then ask why they want to know my age, silence.................

I don't see your problem. Your comment to their question about your age immediately shows you up as a potential trouble maker. Who wants to employ a person like that (of any age ).

Technically, it is now illegal for a prospective employer to ask your age.
They currently have a loophole though whereby they ask for your date of birth for equalities monitoring purposes! The irony!!!

One day there will be a test case and this practice is likely to become illegal under precedent, but until then........

if it's on the application form why do they have to ask.

A lady can decline to give her age. Age discrimination is a very hard thing to prove though.

No they cannot ask that during interviewing or any other time for that matter.

They can ask if you are over 18 and in some cases 21 if it is required that you be over a certain age for the job.

The ADEA does not specifically prohibit an employer from asking an applicant's age or date of birth. However, because such inquiries may deter older workers from applying for employment or may otherwise indicate possible intent to discriminate based on age, requests for age information will be closely scrutinized to make sure that the inquiry was made for a lawful purpose, rather than for a purpose prohibited by the ADEA.

Facts About Age Discrimination

Chapter 21, Texas Labor Code and The Age Discrimination in Employment Act of 1967 (ADEA) protects individuals who are 40 years of age or older from employment discrimination based on age. The ADEA's protections apply to both employees and job applicants. Under the ADEA, it is unlawful to discriminate against a person because of his/her age with respect to any term, condition, or privilege of employment -- including, but not limited to, hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training. It is also unlawful to retaliate against an individual for opposing employment practices that discriminate based on age or for filing an age discrimination charge, testifying, or participating in any way in an investigation, proceeding, or litigation under the ADEA. The ADEA applies to employers with 20 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations, as well as to the federal government.
