If a guy sneaks into the U.S. without a visa, and works and is paid in cash, does the law require him to pay a

percentage of that money to the IRS, as income tax?

Once you make more than a set amount (I think around $200) you will need to declare it as income. How do you think they put Al Capone away for 10 years? It was for income tax evasion. They proved that he was receiving income and never paid taxes!

As the other posters indicated, both the employer and employee would be on the hook to the IRS (and INS).

Better hope congress can pass something to help all of these workers and companies legalize soon (but don't hold your breath, it probably won't happen until GW is out of office).

I believe the employer would be subject to fines for hiring an illegal. The employer is suppose to require proof of citizenship or residency and that would include a social security number.

In your example, it sounds like the guy was paid cash under the table which is against the law. The employer could get in a lot of trouble with IRS.

First of all this would probaly never happen because when you apply for a job the person who is hiring you would cheak you're citazian ship and if you were not from the country they would cheak to make sure that you had a visa, second if a person was able to sneek into the US without a visa they would be deported sent back to there home country and have to go to court to see if they would go to jail,

Got some friends you want to bring in? That person should be arrested and sent home. The employer should pay a big fine and do hard time for hiring an undocumented worker and paying cash to avoid reporting his own taxes.

Actually, the employer should be forced out of business. The business should be seized by the government and sold out from under him. If more harsh action was taken when illegals are discovered working under the table, there would be less and less of them thinking they can get a 'free ride' here and the employers who hire them would eventually be put out of business. Problem solved!!!!

How could the government require someone they know nothing about and have him pay taxes on money that wasn´t reported?

Well sometimes they do catch onto these situations and can go after the company. Technically anyone that earns money in the U.S. is required to report it and pay any taxes due. There is little ability to collect from the non-citizen but they can deport him.

Of course not...because the IRS isn't even aware that the person is in the USA, and the employer broke the law paying them off the books to start with.

Why do you think they all work for cash?

Yes, the law requires him to pay income tax, the same as anyone else would whether they are in the country legally or illegally.
