If a salaried employee works less than 40 hours in one week, may the employer deduct from the employee's pay? ?
Find answers to your legal question.

If a salaried employee works less than 40 hours in one week, may the employer deduct from the employee's pay? ?

I am provided with a daily "list" of duties to perform, and am told that if I'm done them before the 8 hour day expires, I am to "find something to do" and given no other direction. I am paid a yearly salary to complete the tasks provided to me ... but can my salary be reduced on a per-pay basis should I not require the full 8 hours to complete my job in accordance with company guidelines?

I worked for a casino that paid me salary and if I missed a day, they did not pay me for it. They didn't keep track of my hours, per se, like I didn't have to punch a clock, but I filled in a timesheet every now and then that said my hours redundantly every day and it wasn't completely accurate.

If they are making you punch a clock, then I say definitely they can deduct your pay. I think the best solution is to speak openly about this situation with your immediate boss and figure out what's best for you and the company. Otherwise you should definitely "find something to do so you are always busy. Your job sounds like the military...you are given tons of time to do stuff and you have to figure out how to make it take forever. Or if you are an over achiever like me, find stuff to do to keep busy which may require cleaning or organizing random stuff. I can't stand down time. Or you can work something out with the employer to let you do your job in less time and take more time off and you can get evening work. Whatever works out better for your situation.

I just hope they don't realize that your job can be done as a part-time employee (32 hours or less) and then they let you go. If the Dems win tomorrow, all companies are going to be taxed more and they may start cutting positions.

If you are considered 'salaried' then you should be receiving at least 40 hours of pay each week no matter how much you actually work. That is the benefits of being paid salary. I am currently paid salary non exempt and I am expected to work at least 40 hours. The plus side to my position is the nonexempt part. If I work over I get OT.

It is not unreasonable for your employer to expect you to work the full 8 hours. Tell them you need some more guidance when your 'task list' is complete. If you are having a problem coming up with things to do, I'm sure someone else at your work needs help.

Sure they can dock you if you don't work the full 8 hours. They specified that if you have your list completed before you've worked the full day, you should find something else to do - presumably that means something else that BENEFITS THEM.
