If an employer doesnt give the paycheck because they forgot to get a copy of ID & Social is that illegal?

My employer hasnt asked me for my Identification or my social security card, not even a copy. I have only worked there for 3 days, but payday is tomorrow and I don't know if i'll be receiving a check or not. Is it illegal for them not to pay me my paycheck because they forgot to get a copy of my ID and social? What can I do if i dont get my check?

1. you probably won't get a check, due to the fact that this pay-day is for the last pay-period which you probably don't have any hours on.

2. you need to be proactive and get your social and identification taken care of so you don't have any problems getting your first check cut when the time comes.

3. your pay can not be held from you due to the employers incompetence however............................
they can take you off the schedule and even terminate you if need be if you fail to take care of this ASAP.

If payday is tomorrow, then the pay period probably ended last week, or at least before you began. That means that the other workers are getting paid tomorrow for work they did last week and before. You weren't a part of that pay period, so you won't be paid anything tomorrow. I would ask your employer what he/she needs from you in order for you to get paid. If you know he/she doesn't have what's needed, then you are just as much at fault as they are. You're not going to be paid this paycheck anyway so don't get upset over it. But if they don't have what they need, then they probably couldn't pay you. They would owe you the money and pay up when the information they need is provided.

If you work, they HAVE to pay you. Thats about the only law the working man/woman has on his side.

No You will not get paid your not in the payroll system. but howerver the must pay you within two weeks

If you work the hours they are required to pay you. I doubt that you will get a check tomorrow as you only started 3 days ago. Most likely the wages worked this week are to be paid in the next paycheck. In most cases you are paid one pay period afterwards. Example - Employee starts work 7/7/08, pay periods are every other Friday, so first pay day would be 7/11. The paycheck paid on 7/11 would pay employees through Friday July 4th. The next check on 7/25 would pay employees for hours worked 7/5 through 7/18.

Ask HR how your pay period cycles run and what the check tomorrow pays people through.

They probably forgot to ask you. In most cases it would be illegal for them to pay you before seeing these documents. If you want to get on their good side, call the person who hired you and ask if they need to see them. If you want to get on their bad side, say nothing and wait for them to notice that they forgot to get them..

I doubt that you will be paid tomorrow. Most companies have a week that they are behind.

For instance, the checks that are tomorrow, the time for that probably ended last friday or before.

If they hired you without getting proof of your age, ID or social security card, that is NOT justification for NOT paying you! They can, however, require you to produce proof of such information in order to be GIVEN your check. I would wait and see if they GIVE you your check first. Be prepared with your documents just in case and then they will have no reason NOT to pay you! I mean really, this isn't rocket science! Three days pay and they are going to stiff you? Or you think they are going to stiff you? There is more to this than you are giving. If they fail to pay you, you can sue them in small claims court and eventually, you will get paid, but you may also be required to document who you are to the judge and supply any missing papers that may be required. Just because an employer didn't get your documentation, doesn't mean you won't get paid. I hire lots of people without any ID, but they are simply day labor, kids or temps. If I were running a business, it would have to be different, as you need to do withholding, SS, and unemployment and all that stuff. Independent contractors operate differently. The three days you have worked are probably not in the pay period that these checks (tomorrow) are being issued for. usually you have to wait to get paid at the second pay day when you first get hired onto a new job, since the paychecks being issued tomorrow probably don't include this week--that would be the next pay period. You know?

However, that being said, it is your employer's responsibility to collect the necessary information from you in order to pay you on time. You should ask if they need that information from you and when you should expect to receive your first paycheck. Be polite and respectful, but don't take any b.s. either! If you are having problems collecting a paycheck, contact the Better Business Bureau and report you employer!
