If colleagues collude and make false statements.?
|
I lost my job because colleagues colluded and made false allegations against me. I lost my job for gross misconduct and my career is at an end. Is collusion of this type illegal? Can I take legal action against them? Additional Details Unfortunately I can't move on as I am too old to retrain. Also my integrity and character has been destroyed and this is a very small community. Reputation not money is the issue.

Erm, I think you have answered your own question!?!?!
"I do have concrete proof of at least two lies in their signed statements and that collusion took place. I have an employment tribunal to get through first and my solicitor should have no problem establishing that lies were told. Then I can take it further maybe." |

You could sue them, but would probably have a very hard time proving your case.
Good luck - this really stinks! |

You actually don't need to prove they said it. Onus of proof is on the defendant so they have to prove they didn't i think. Migtht depend on your country. |

I had the exact thing! and it really hurts to know that I was hated that much from there sheer jealousy. But you have to be a little more open on what you where accused of, then maybe we can give better advice. : )
I think you could if you can prove it sue for slander and deformition of character . I feel so sorry for you, but go and see a legal rep get some real advice at least then it will put your mind at rest. |

You can sue for slander and defamation of character. You will need to be able to prove what they said, that they said it, and that the intent was to cause you harm. |

In practical terms you will need concrete proof of the collusion and its negative effects before you take any action. You should also consider what reparation you are seeking, because often the compensation is less than the legal costs you could incur to bring a case.
Unfortunately justice is mainly for the wealthy.
It might be better to move on.
Collusion is notoriously hard to prove even if you prove that your colleagues have lied. I see that you've added that you are going to an industrial tribunal.
Your ex-colleagues will be asked to read their statements into the record to verify the truth of them, if they do so and you can prove they have lied there may be a case of defamation to answer, but once again it is horrendously expensive, much more costly than any award you might receive.
Even if you prove defamation you also have to prove that you have the type of profile that will be publicly harmed by their alleged defamation.
Typically an award is a tiny percentage of the costs and you could also end up footing your opponents legal costs as well.
I'm sorry for your position but you should carefully consider this type of legal action, as wrong as it seems many a principled man has been bankrupted by the justice system. |

I suggest you ask yourself why(if indeed) your colleague colluded to get you dismissed.
I have been pretty unpopular at some times during my career but I have never knowingly had staff conspire to effect my dismissal.
Possibly your psychopathic hatred of cats makes you such unpleasant company that people will stop at nothing to be rid of you. Obviously if your employer dismissed you on the basis of false evidence you will obtain compensation. A supplementary action for liable could be brought against your former colleagues but you will have to fund the case entirely from your own resources and may be required to put up a bond or take out insurance for the defendants' coats, should your action fail. |

I have no idea how you can come out of this unscathed, but rest assured they have to face their maker in the end. |
