If he cashed his check does it void the signed document?

My husband got fired from his job. He is being accused of theft. The day his ex employer fired him he had my husband sign a document stating why my husband was being let go, that he wasn't going to pay him his final check and that he wouldn't press any charges. They both signed and dated the document although my husband was under distress when he signed. Since his ex employer was not going to pay him his final check he was going to go through The Bureau of Labor and Industries to fight for his check. He let his ex employer know he was going to make a claim. Then 3 days after my husband was fired his ex employer informed him that he was going to press charges.
My husband received a copy of the document along with his final check. We are wondering if my husband were to deposit his check will that void the document that they signed and give his ex employer any grounds to press any charges? Any advice would be helpful. Thanks for your time.

cash the check and let the employer try to prove their case.


the employer can not hold the pay-check for ANY reason and the agreement was illegal (and unenforceable by either party) to begin with.

the employer can file charges either way if they have proof it does not matter what was signed. this employer is just trying to scam your husband out of his last earned pay...that is illegal.

Depositing that check voids the agreement and the employer will press charges. Not cashing the check your husband get off easy. No charges, no lawyer fees, no record and he can go get a job somewhere else. His choice. If he is not guilty then he should fight.

don't cash the check and call husbands ex employer and let him know that you are sorry and that you would like to get past this with out going to court. Good luck...
