He works for a very shady company that likes to rip off current and former employees so when he was offered a better job with a guaranteed minimum salary, he obviously took it. He is starting is new job on October 27th, My question is if he doesn't finish up the month (there will only be 5 days left in the month after he leaves) is he still entitled to the commission that he earned up to that point? He does not have a contract with his current company because they don't believe in them (also makes it easier for them to deny benefits that they verbally promised). We live in Wisconsin, if that makes any difference.

Wisconsin requires pay-days to be at least once a month.
if his commissions are due when the client pays then the employer must pay all commissions due as normal and the remaining outstanding commissions within 31 days.
regardless of when your husband quits he is due the commissions he has earned up to that point.
this is all based on the commissions being his mode of earnings and not bonuses paid on top of his earnings. if he receives commissions as a bonus then the employer can have a policy that states the employee must be currently employed to receive a bonus and there fore they could withhold these commissions. |

Entirely up to the Company, No legal requirements as long as he is paid the "minimum" wage.
Some commission/bonus plans require that an employee be employed at the time it is paid, others at the end of the month, others do pro-rating.
No definite answer except what is the Company's policy? |
