If someone faces damages due to wrong advice of his friend; can that friend be punished (India)? see details.?

Imagine someone 'P' sends his child in some expensive scool suggested by his friend 'N'.
'P' gets good reports about that scool from 'N'.
But few months later after admission 'P' feels that his child is not studying well there ; that scool's staff is also not good and moreover P's child gets many new bad habits in that scool .
'P' blames his friend 'N' for this all..
Can 'P' sue 'N' for all damages he suffered (India)???

simple answer is NO. u cant legally blame anbyone for giving advise. Only the person who accepts his frineds advise blindly is to be blamed . but there is no legal angle to it. |

Forget India, i don't think anywhere in the world there is a legal damages case in your illustration.
So dont waste time on all this, take the next step, if you are not satisfied with the school , get him admission in other school.

I hate to attempt an answer here since laws in India could be very different than in the U.S.A. But if all "N" did was recommend a school and "P" elected to take that advice, then "P" became dissatisfied it could hardly be blamed on "N."
If "N" had recommended a restaurant and you went but didn't like the food you could not sue "N" for the suggestion because "N" liked the food there. Unless there was malicious intent or some sort of personal gain for "N" making his suggestion I hardly see a lawsuit being successful. In fact, "P" had some responsibility to investigate and evaluate the school on his own beforehand if he didn't he is more to blame than "N" could ever be. |
