If spouse gets job out of state can I claim unemployment?
Find answers to your legal question.

If spouse gets job out of state can I claim unemployment?

My new spouse got a residency in MA, and we only found out the begining of this month that she is going. I currently live in IL and would like to move with her. I heard that I can claim unemployment if you have to move states due to a spouse. Do you know if this is true and what state I have to do the paperwork in?

Thanks in advance

If you quit, you cannot collect unemployment. Furthermore, unemployment insurance funds are actually bankrupt in almost all states, and federal UI extensions are up in the air, i.e. Congress is battling over them again. Don't rely on unemployment anywhere!

Start applying for jobs in MA right away, keep your current job as long as you possibly can while you find something in MA. Of course, you want to be together, but the job market is an absolute stinker and you need to work. Really hustle on that job hunt!

AFAIK, that "moved to follow a spouse" rule is generally only for people who move to follow an active-duty military spouse, and not all states have this rule. If wifey is a civilian, you get zip.

Unemployment is basically based on if you leave a job "through no fault of your own". That means if you are fired for anything but gross misconduct (theft, destruction of property, etc.) then you are likely eligible.

If you quit because you are relocating with your spouse, that would be your "fault" or decision, and would probably disqualify you for benefits.

This link: http://nelp.bluestatedigital.com/page/-/UI/cwce_book/BenefitstoWorkers.pdf talks about trailing spouses and unemployment. I don't know how current this is, but it's probably a good indicator of what to expect. MA denies unemployment benefits to training spouses.
