unless you have a contract stating wages or are in a union, employment is "at will". you can leave when you want and they can pay you waht they agreed to upon hire.

prove yourself to be a good foreman and maybe you will get a raise.

If you work on contract based job its not a problem.
May be the other dude is more experienced?
May be he was hired when it was difficult to find people like him and the boss agreed to pay more?
To prove that you are disseminated you will need proof and a motive.

Sure it's legal. As long as you are making at least minimum wage, the company can pay you whatever you and they agreed to - if your duties are changed, they have no legal requirement to pay you more unless you have a contract that says that they do.

It's as legal as you'll allow it to be.
