If you get fired from your job because you are convicted of a serious criminal offence, and then later your?

conviction is quashed on appeal,do your former employers have to take you back even if your job has been filled

Nope. Most states are "At Will" employment. This means they can fire you for any reason. They do NOT need to hire you back.

However, assuming that your conviction was quashed because there was proof that you did not commit the crime, and assuming that you were a good employee -- there is no reason the company wouldn't take you back if there was another position you were qualified for.

No, they don't have to take you back. A felony conviction is grounds to termiante an employee and there is no reinstatement requirement even if the conviction is subsequently overturned.

No, there's no such protected class for those who were convicted and later exonerated or their convictions reversed. If you have to answer why you are no longer at your former employer, just explain what happened and that your conviction was overturned.

No. Because it's not a protected class.

Most people that get arrested are guilty at minimum, by association. It has to do with the company you keep.
